Part A — Website Terms of Use
Part B — Privacy Policy
This single document sets out the two policies that currently apply to the akomira website at akomira.ai and akomira.com.au (Website), operated by akomira (ABN 55 816 493 469) (akomira, we, us or our): our Website Terms of Use (Part A) and our Privacy Policy (Part B). Both parts apply together. Where the tutoring service itself is discussed, note that it is not yet available - see Part A, clause A1.
PART A
Website Terms of Use
These Website Terms of Use (Terms) apply to your use of the Website. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website. These Terms apply to the Website only; they do not apply to the tutoring service, which is not yet available.
A1. The Website is currently informational only
akomira is preparing to launch a mathematics tutoring service for students in Years 6 to 9 in Victoria, Australia, combining an AI tutor with sessions delivered by human tutors.
That service is not yet available. At present the Website provides information about akomira and allows you to register your interest. No tutoring service is being offered or supplied through the Website at this time.
When the service becomes available, separate Terms and Conditions will apply to its use, and you will be asked to agree to them.
A2. Registering your interest
Contact details must be provided through the Website by a parent, guardian, educator, or other adult aged 18 years or older. By submitting contact details, you warrant that you are 18 years or older.
If you provide contact details to register interest:
where you have consented to receiving them, you consent to us contacting you about the launch of akomira and related updates;
you may unsubscribe at any time by contacting us. We will action an unsubscribe request within 5 working days; and
we will keep a record of the consent you give, including when and how you gave it.
Registering interest does not create any obligation on either of us. It does not reserve a place, guarantee access, or commit you to purchasing anything, and it does not by itself entitle you to any launch offer. We handle your details in accordance with Part B (Privacy Policy) of this document.
A3. Launch offer
From time to time before launch, we may promote a launch offer. Where we do, the details of that offer — including what it includes, who is eligible, and any conditions or closing date — will be set out on the Website at the time it is offered.
Any launch offer is subject to the tutoring service actually launching, and to you agreeing to the full Terms and Conditions that will apply to the service at that time. We may vary, suspend or withdraw a launch offer before launch, and we will take reasonable steps to notify people who have registered interest if we do.
Applying for or expressing interest in a launch offer does not create a binding agreement between us and does not guarantee that you will receive the offer.
If a launch offer involves any element of chance, including any prize draw or random selection, it is offered subject to the conditions published with it and only in those States and Territories in which we are permitted to offer it.
Any prepaid credit, voucher or gift card we issue in connection with a launch offer will be valid for at least one year from the date of issue, and we will not charge you a fee for using it.
A4. Information on the Website
We aim to keep the Website accurate and current, but information about our planned service — including features, curriculum coverage, pricing, and launch timing — is indicative and may change before launch.
Nothing on the Website is an offer capable of acceptance, and nothing on the Website should be relied on as a promise about what the service will include or when it will be available.
Where the Website describes AI-assisted tutoring, that description is indicative of what we are building. Artificial Intelligence (AI) can produce explanations and worked solutions that contain errors, including errors of mathematical reasoning. Any AI feature we launch is intended to support instruction by a human, not to replace it, and should not be relied on as a source of mathematical truth.
A5. No educational guarantees
Any information on the Website about how tutoring may support a student's learning is general in nature. We do not guarantee any particular academic outcome, result, grade, or level of improvement, either now or once the service launches.
Where we describe results that students have achieved, we are describing what some students have achieved and not making any promise about what your child will achieve. Learning outcomes depend on many factors outside our control, including the student's engagement, attendance and circumstances.
A6. Our commitment to child safety
akomira is committed to the safety, wellbeing and empowerment of every child and young person who uses our service. We comply with the Victorian Child Safe Standards made under the Child Wellbeing and Safety Act 2005 (Vic), which apply to entities providing coaching or tuition services specifically for children.
We have zero tolerance for child abuse of any kind. We take every allegation and every concern seriously.
Every tutor engaged by akomira will hold a current Victorian Working with Children Check for paid work or will be a teacher registered with the Victorian Institute of Teaching who has notified Working with Children Check Victoria of their engagement with us. We verify clearances before engagement and monitor their currency.
Every tutor is bound by our Child Safe Code of Conduct. Among other things, it prohibits contacting a student outside the akomira platform, private messaging outside supervised channels, giving gifts to students, and arranging to meet a student in person for tutoring without consent of parents.
We are committed to the cultural safety of Aboriginal and Torres Strait Islander children and young people, to the safety of children with disability, and to the safety of children from culturally and linguistically diverse backgrounds and of every sexual orientation and gender identity.
Students, parents, carers and anyone else can raise a child safety concern with us at any time by emailing hello@akomira.com.au. We will respond to every report and tell you what we have done. No student will be disadvantaged for raising a concern.
Where a concern involves conduct that may be criminal, we will report it to Victoria Police. If a child is at immediate risk, call 000.
A7. Intellectual property
All content on the Website — including text, graphics, logos, branding, and design — is owned by akomira or its licensors and is protected by law. You may view and print pages for your own personal, non-commercial use. You must not otherwise copy, reproduce, modify, distribute, or commercially exploit any part of the Website without our written permission.
If you send us any material through the Website, you grant us a non-exclusive, royalty-free license to use it for the purpose of responding to you and operating the Website. You confirm that you are entitled to grant that license.
Some material referred to on the Website may be owned by third parties, including the Victorian Curriculum and Assessment Authority. That material is used subject to the terms on which it is made available, and nothing on the Website transfers any right in it to you.
We do not permit any material collected from the Website, and we will not permit any student work or personal information collected once the tutoring service launches, to be used to train any third-party artificial intelligence model.
A8. Acceptable use
You must not:
use the Website for any unlawful purpose;
attempt to gain unauthorized access to the Website or its systems;
interfere with or disrupt the Website; or
scrape, harvest, or systematically extract content from the Website.
access the Website by any automated means, including any bot, crawler or scraper, except a search engine crawler operating in accordance with our robots file;
extract, copy or use any part of the Website to train, fine-tune or evaluate any artificial intelligence or machine learning model; or
impersonate any person or submit contact details that are not yours or that you are not authorized to provide.
If we reasonably believe you have breached this clause, we may suspend or block your access to the Website, and we may take any other step available to us at law.
A9. Third-party links
The Website may link to third-party websites. We do not control those sites and are not responsible for their content, products, or privacy practices. Links are provided for convenience only and do not imply endorsement.
A10. Consumer guarantees and liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.
Subject to the paragraph above, and to the extent permitted by law, we are not liable for any loss or damage arising from your use of, or inability to use, the Website, or from reliance on information published on it, except to the extent that the loss or damage is caused by our negligence, our breach of these Terms, or our breach of law.
Subject to the paragraph above, and to the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profits, or loss of opportunity.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.
A11. Changes
We may update these Terms from time to time. The current version will always be available on the Website, showing the date when it took effect.
Where we make a change that materially affects your rights, we will take reasonable steps to notify you before it takes effect, including by email if you have registered your interest. Changes do not apply retrospectively.
If you do not agree with an updated version, you may stop using the Website. Continued use of the Website after a change takes effect means you accept the updated Terms.
We may also change, suspend, or withdraw the Website, or any part of it, at any time.
A12. Complaints and disputes
If you have a concern about the Website or about how we have dealt with you, please tell us first by emailing hello@akomira.com.au. We will acknowledge your complaint within 5 business days and give you a substantive response within 30 days.
A concern about the safety of a child is dealt with under clause A6 and our Child Safety and Wellbeing Policy and is escalated immediately.
A concern about how we have handled personal information is dealt with under Part B of this document.
If you are not satisfied with our response, you may contact Consumer Affairs Victoria or apply to the Victorian Civil and Administrative Tribunal. Nothing in this clause prevents you from taking any action you are entitled to take.
A13. General
If any part of these Terms is found to be unenforceable, that part is severed and the rest of the Terms continue to apply.
If we do not exercise a right under these Terms, that is not a waiver of that right.
These Terms, together with our Privacy Policy in Part B, are the entire agreement between you and us in relation to your use of the Website.
We may assign or novate our rights and obligations under these Terms on notice to you, including on a sale or restructure of our business. You may not assign yours without our consent, which we will not unreasonably withhold.
Nothing in these Terms creates a partnership, agency, joint venture or employment relationship between us.
We are not liable for any failure or delay in operating the Website caused by something beyond our reasonable control.
Notices to us may be sent through either the Contact us section or by emailing us at hello@akomira.com.au. Notices to you may be sent to the email address you have given us.
Clauses A6, A7, A10, A12, A13 and A14 survive any withdrawal of the Website.
A14. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and akomira submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
PART B
Privacy Policy
akomira respects your privacy. This Privacy Policy explains how we handle personal information collected through the Website.
We have chosen to be treated as an organization bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and we handle personal information accordingly. Where we hold health information in Victoria, we also comply with the Health Records Act 2001 (Vic) and the Health Privacy Principles.
B1. Scope of this Policy
akomira is preparing to launch a mathematics tutoring service for students in Victoria, Australia in Years 6 to 9. That service is not yet available.
This Policy covers only the information we collect through our Website before launch — principally, details provided by people who contact us or apply for the launch offer. It does not cover the tutoring service, because that service is not operating yet.
Before any student uses the tutoring service, we will publish a fuller Privacy Policy covering student information, learning data, AI processing, and tutoring sessions, and we will seek the consents required at that time.
B2. Children and parental consent
The tutoring service is intended for students in Victoria, Australia in Years 6 to 9. Before launch, however, contact details must be provided through the Website by a parent, guardian, educator, or other adult aged 18 or older - not by a student.
If a student under 18 would like to hear from us, we ask that they provide their parent's or guardian's email address rather than their own, so that we can confirm with the parent or guardian before adding anyone to our list.
We do not seek to collect personal information from children through the Website, and the Website asks every person submitting details to confirm that they are 18 or older. Whether a young person has capacity to consent to us handling their own personal information is assessed individually; as a general position we treat a person aged under 15 as not having that capacity.
If we become aware that a child has provided us with their own personal information without a parent or guardian's involvement, we will delete it. If you believe this has happened, please contact us.
B3. What we collect
Through the Website we may collect:
Contact details you provide when you contact us or apply for the launch offer - such as your name and email address, whether you are a parent, guardian or educator, and any other details you choose to give us.
Enquiry content — the contents of any message you send us.
Technical and usage information collected automatically, such as device type, browser, IP address, and how you use the Website.
Consent records - a record of the consent you give, including when and how you gave it.
B4. Sensitive and health information
Some information you might give us - for example, information about a student's learning difficulties, disability, diagnosis or health - is sensitive information under the Privacy Act 1988 (Cth) and may also be health information under the Health Records Act 2001 (Vic).
We do not ask for this information before launch, and you do not need to give it to us. If you choose to include it in a message to us, we will collect it only because you have given it to us, we will use it only to respond to you, and we will not use it for marketing.
We will not disclose sensitive information other than to those of our people who need it in order to respond to you, unless you ask us to or we are required by law.
B5. How we use it
We use the personal information we collect to:
contact you about the launch of akomira and send related updates you have asked for;
respond to your enquiries;
understand interest in the service and improve our Website; and
meet our legal obligations.
meet our child safety obligations, including under the Child Wellbeing and Safety Act 2005 (Vic) and the Crimes Act 1958 (Vic).
We use personal information for direct marketing only where you have consented to it. You can unsubscribe from our marketing emails at any time by contacting us, and we will action your request within 5 working days. We will not use sensitive information for direct marketing.
You may deal with us anonymously or under a pseudonym if you wish, although we will not be able to email you about the launch if you do.
B6. Who we share it with
We may share personal information with:
service providers who help us operate the Website and communicate with you, including Squarespace (website hosting) and Google (email);
professional advisers, where reasonably necessary; and
others where required or authorized by law.
any provider of artificial intelligence services we engage, once the tutoring service launches, on terms requiring it to handle personal information consistently with Australian privacy law and not to use it to train its models.
We do not sell personal information.
B7. Where information is stored
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorized access, modification or disclosure. Those steps include technical measures such as encryption in transit, access controls and multi-factor authentication on our accounts, and organizational measures such as limiting access to those who need it and training our people.
Some of the personal information we collect is stored outside Australia. Our website provider, Squarespace, stores data in data centers in the United States. Our email provider, Google, may also store data in the United States and in other countries in which it operates. These countries may have data protection laws that differ from those in Australia. We take reasonable steps to ensure that overseas recipients handle personal information consistently with the Australian Privacy Principles.
We remain accountable for personal information we disclose to an overseas recipient, and we put contractual arrangements in place with those recipients.
B8. Data breaches
If we suspect a data breach involving personal information we hold, we will assess it promptly and in any event within 30 days.
If the breach is likely to result in serious harm, we will notify the Office of the Australian Information Commissioner and the individuals at risk as soon as practicable and tell them what happened and what they should do.
B9. Automated decision-making and artificial intelligence
We do not currently use any computer program to make decisions about you. The Website is informational only.
Once the tutoring service launches, artificial intelligence will be used to generate explanations, practice questions and progress insights. We will not use it to make any decision that has a legal or similarly significant effect on a student. Where it contributes to a recommendation about a student's level, pathway or support, a human tutor will review that recommendation before we act on it or report it to you.
When the service launches, we will publish, in our fuller Privacy Policy, the kinds of personal information used in any such program and the kinds of decisions it is involved in.
B10. Cookies and tracking
Our Website uses cookies — small files stored on your device — to help the site function and to understand how it is used. Some cookies are essential to the operation of the Website and are set by our website provider, Squarespace. Others help us analyze how visitors use the site.
You can control or disable cookies through your browser settings, although some parts of the Website may not work properly if you do.
B11. How long we keep it
We keep the contact details you provide until you unsubscribe or ask us to delete them, or until we no longer need them, whichever comes first, and in any event no longer than 24 months after your last interaction with us. If you unsubscribe, we may retain a minimal record so we can honor your request not to be contacted.
Where a student has provided a parent's or guardian's email address and we do not receive a response from that parent or guardian, we will delete the details we hold.
B12. Access, correction and deletion
You may ask us to access, correct, or delete the personal information we hold about you by contacting us. We will respond within 30 days. There is no charge to make a request. If we refuse a request, we will explain why and tell you how to complain.
We may need to keep some information where the law requires it or where we need it to deal with a complaint or a legal claim. If that applies, we will tell you.
B13. Complaints
If you have a concern about how we have handled your personal information, please contact us first so we can try to resolve it. We will acknowledge your complaint within 5 business days and give you a substantive response within 30 days.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au. If your complaint concerns health information, you may instead contact the Office of the Victorian Information Commissioner (OVIC) at www.ovic.vic.gov.au or the Health Complaints Commissioner at hcc.vic.gov.au.
B14. Changes to this Policy
We may update this Policy from time to time. The current version will always be available on the Website. This Policy will be replaced with a fuller version before the tutoring service launches.
